Many complain that religions consider themselves to be above the law.
They are correct in coming to that conclusion as section 116 of the Australian Constitution ensures that no restriction can be placed on the free exercise of religion thus leaving religions above the law in Australia.
The same religions that covered up the rape of children for decades are still above the law in Australia
Children will continue to be raped and cheated of the life they have a human right to while this circumstance remains unchanged.
While ever a religion has this protection without any requirement for validation of the suitability of religious laws to ensure the safety and soundness of the law and that it ensures the safety and the protection of the human rights of children Australia will have failed to bring genuine protection despite its recent half a billion dollar attempt to do so.
Perhaps there is no longer reason to wonder why Australia has failed for 70 years in its aspirations to bring human rights to its people - the free exercise of religion in our laws and our Constitution have no controls of substance with which to suitably protect its children from the designs of pedophile clergy bent on raping children under the protection of our Constitution and our weak human rights regulations simply because they can do that with immunity and those who want to do it for their own religious needs can do that also.
Such outcomes are absurd and are a gross abuse of the human rights of the people of Australia.
Any rapist from any religion can freely use Australia's religious freedom laws to gain sexual access to children
Does section 116 of the Australian Constitution allow religions the ability to protect rapist clergy and non clergy rapists among them?.
The outcome we have today may not have been the intention of those who wrote and supported the wording of this clause however that children and women have been subjected to wholesale rape by clergy is indeed the outcome that we do have and the fact is that the deluded and the criminal along with genuine people can be duped and drawn into enabling and hiding the most egregious possible sexual crimes against children when it is enacted in the name of a religion.
The question now is narrowing down to clear and basic choices as to whether Australia wants to protect its children or if it wants to protect the rights of religions to remain unregulated and unaccountable so that pedophile clergy among them can and do remain free to rape when it is claimed to be a part of the spiritual journey of clerics.
Clergy don't just think they are above the law our Constitution gives them that right and protects the psychopathic grasp of the rapists among them
That such criminal behaviour can be successfully protected through the immunity provided by section 116 of Australia's Constitution needs to be addressed immediately by every government, child care and human rights interest in the country.

As we unpack the twisted history of the abuse of children in institutions it can more easily describe some of the anomalies such as to how could 8 police jurisdictions come to the same or similar actions that they did take for over 100 years without actually conspiring to pervert the course of justice for their fellow Australians. This may assist in answering why in some instances clergy did not face the courts when they should have. Will this be the only answer Australians will get - history hopefully will answer this more clearly.
The constitutions of Australia and the United States are two constitutions that I am aware of that allow this. Are you aware of this in other countries?

It is legal, logical and factual to say that the Australian Constitution cedes its entire authority to the Vatican and the Holy See via 116. It is also a fact that the majority of politicians do not want to address this issue.

Will you see this with the same degree of concern tomorrow? Step beyond a trauma driven response as our reality will only be diminished if too many of us find it too unsettling to take action. Remind yourself to recall this article each Thursday on into the future so you can check if you can raise awareness of the need for action and a review of this at government level for the sake of all children to come in the future.

Children will be denied their human rights, denied the basic right to develop into human beings able to achieve their full potential. The global experience, one that Australian communities shared, demonstrated beyond question that children were not only allowed to be sexually abused and used by clergy who knew themselves to be protected by their churches but who also relied on the current status in law to continue to prey on children. The rape, the physical and emotional abuse of those entrusted in the care of churches not only impacted on thousands of young Australians but it also adds a considerable financial burden to the community in lost potential, lost skills and the cost of maintaining people who are unable to function fully in a society .... the trauma is not only experienced by the child survivors but the entire community..(resources and monies essentially stolen from the public purse to maintain a level of criminality yet to be fully understood by the public and its government.).
Whereas Australia recognizes beyond question the right of all the [right to] practice their faith , the practical implications of such practices are not addressed. Christian faith, as held true on a very basic level, hijacked to pander to the very inhuman and certainly not Christian desire to use sexual [abuse] for personal sexual gratification and gain. Such aberrations and criminality obviously not dealt with by organizations confusedly focused on saving the construct of 'souls' whilst abandoning bodies and psychological well being..
The responses by churches and faith groups to the findings of the Australian Royal Commission highlighting the very failure of the churches and faith based organizations to accept the failure in their duty of care, responses that should have occurred generations ago not having taken place until the crimes against children and communities were exposed. This level of cognitive dissonance highlights the crisis brought on by the special status of religion in an otherwise secular state.

Investigation of an unsolved murder in 1962 can no longer be investigated according to police taskforce SANO because a pedophile Catholic clergyman who raped a child at age 8 is now dead. As a result of the dead rapist being unconnected with the murder Victorian police remain clueless.
Later in life John married in Toowoomba only to find that he was related to the then bishop of Toowoomba Bill Morris. Morris was the head of the bishops conference and was the go to person in the country for survivors of childhood sexual abuse by Catholic clergy and yet I was never able to get a time or a conversation with the bishop. I did get conversations or connection with a number of Catholic organisations with varying degrees of weirdness.
